JUSTICE SANJAY PRIYA ORAL ORDER 01-11-2018 Heard learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Dehri (Dalmiyanagar) P.S. Case No. 524/2018, instituted for the offences under Sections 376, 511, 307, 452 and 354(a) of the Indian Penal Code. It is alleged in the written report that one unknown person entered into room of informant and forcibly committed rape with her at the point of revolver.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. He has been identified by the informant on the basis of photograph as mentioned in para 69 of case diary. It is further submitted that after aforesaid identification T.I.P. was held, wherein informant

Patna High Court Cr.Misc. No.55779 of 2018 (3) dt.01-11-2018 2/2 has failed to identify this petitioner. It is further submitted that victim herself has refused for medical examination. Petitioner is in custody since 07.07.2018.

Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri (Rohtas) in connection with Dehri (Dalmiyanagar) P.S. Case No. 524/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
