The petitioners pray for anticipatory bail in connection Warisnagar PS case no. 206 of 2015 registered for the offence punishable under under Section 307, 354 and various sections of Indian Penal Code.
Patna High Court Cr.Misc. No.465 of 2017 (2) dt.18-01-2017 2/2 It is submitted on behalf of petitioners that petitioners and informant belong to one and same family and case and counter case is pending between the parties regarding land dispute. It is further submitted that there is allegation of assault but there is no specific allegation against any of the petitioner. Heard learned A.P.P. also. Learned A.P.P. could not point out any specific overt act against the petitioner. Having heard both sides. In view of the fact that case and counter case is pending between the parties, the bail application of petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Warisnagar PS case no. 206 of 2015 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that he will cooperate in the investigation of the case.
