2. The petitioner seeks bail in anticipation of his arrest in connection with Barun P.S. Case No. 83 of 2017 dated 19.05.2017 instituted for the offences under Sections 323, 307 and 366/34 of the Indian Penal Code.

3. His prayer for anticipatory bail was earlier rejected vide order dated 20.12.2018 passed in Cr. Misc. No. 54677 of 2018.

4. The learned Advocate for the petitioner has submitted that after that rejection order, three other accused persons of this case were granted anticipatory bail by this Court vide order dated 14.12.2018 passed in Cr. Misc. No. 64124 of 2018.

5. This is the second attempt of the petitioner to seek anticipatory bail. The petitioner would have been well advised to have surrendered before the Court of law and sought bail. He has not surrendered to the process of law since 2018 when his application was rejected.

6. The prayer for anticipatory bail of the petitioner is thus rejected with the direction that in case the petitioner surrenders before the Court below, the Court below shall take into account that other accused persons have been granted the privilege of anticipatory bail and that a compromise has also been effected between the parties and shall pass orders in accordance with law, without being prejudiced by the fact that twice
