The petitioners seek bail in Masaurhi P.S. Case No. 57 of 2017 registered under Sections 302 and 201/34 of the Indian Penal Code.

As per the prosecution case, nude dead body of a girl aged about 17 years was found in the field of Sandip Singh at Sonkukari village and her undergarments and clothes were found near the dead body.

It has been submitted by learned counsel for the petitioners that they are not named in the F.I.R. There is nothing cogent against the petitioners indicating their complicity in the occurrence. Their names have been surfaced in the confessional statement of a co-accused during course of investigation. The

Patna High Court Cr.Misc. No.37996 of 2017 (02) dt.10-08-2017 2/2 mobile tower locations of the petitioners were not found near the place of occurrence at the time of occurrence. Petitioners have been languishing in custody since 02.03.2017. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Masaurhi, Patna in connection with Masaurhi P.S. Case No.57 of 2017.
