The Petitioner is apprehending his arrest in a case registered for the offences punishable u/s 356, 379 read with 34 of the Indian Penal Code.

As per the prosecution case, two miscreants boarded on a motorcycle snatched the informant's bags containing ATM card, check book, mobile with sim card and Rs. 4,000 in cash and fled away while the informant was returning to her home. Learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.53224 of 2021(2) dt.14-02-2023 2/2 the petitioner has falsely been implicated in this case. The petitioner is not named in the FIR. During the investigation name of the petitioner has surfaced. The petitioner has no criminal antecedent as stated at para 3 of the bail petition. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner. Considering the aforesaid facts and circumstances as well as the nature of allegation against the petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Patna in connection with Khagaul P.S. Case No. 105 of 2020, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure. The application stands allowed.
