2. Petitioner seeks regular bail in connection with Rasulpur P.S. Case No. 54 of 2025 dated 29.03.2025 registered for the offences punishable under sections 126(2), 115(2), 118(2), 303(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita (in short 'BNS') and further, section 109 of BNS was added.

The main submissions advanced by the petitioner's counsel are that the petitioner is 70 year old person and both the parties are agnates and the FIR has been registered against six named accused persons and three unknown individuals and against this petitioner, there is no specific allegation. It is further
Patna High Court CR. MISC. No.43678 of 2025(2) dt.18-07-2025 2/2 submitted that there is a case and counter case between both the parties and the petitioner has fair and clean antecedent and has been languishing in jail since 26.04.2025.
4. Learned APP for the State has opposed the prayer of the petitioner.
5. In the facts and circumstances of this case as well as considering the aforesaid submissions and mainly the petitioner's old age, his fair and clean antecedent and the fact that against him, there is no specific allegation in the FIR in which 6 named and 3 unknown persons have been made accused and coupled with completion of investigation against him, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/-(Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the court concerned in connection with Rasulpur P.S. Case No. 54 of 2025.
