Petitioner is in custody since 04.12.2016 in connection with Mansahi P.S. Case No. 61 of 2016 registered under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, initially the petitioner has not been named in the F.I.R. but during course of investigation, the parents of deceased has disclosed the name of this petitioner only on suspicion. There is no eye witness to the alleged occurrence. Moreover, charges in this case have been framed, which is evident from supplementary affidavit filed on behalf of the petitioner. The petitioner is rotting in custody for the last eight months.
