JUSTICE SANJAY PRIYA ORAL ORDER 29-10-2018 Heard learned counsel for the petitioners, learned APP for the State as well as counsel for the informant. The petitioners seek bail in Guthani P. S. Case No.142 of 2018 instituted for the offence under Section(s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioners has submitted that petitioners have clean antecedent.
In the written report, there is a allegation that four named and two unknown accused persons shot fire on the son of the informant after entering into the School. But, one gun shot injury was found on the person of the deceased in the postmortem report.
Case diary has been received, wherein, the postmortem
Patna High Court Cr.Misc. No.59457 of 2018(3) dt.29-10-2018 2/2 report of the deceased is available. The doctor has found only one gun shot injury on the person of the deceased. In the written report, there is allegation that these petitioners along with two named accused and two unknown persons entered into the School of the informant and caused firearm injury to the son of the informant. The informant is alleged to have seen the petitioners and other accused persons running away on their respective motorcycle from near the Sagwan tree situated near the School.
As per postmortem report only one injury has been found on the person of the deceased.
Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Siwan in connection with Guthani P. S. Case No.142 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioners. (Sanjay Priya, J) shyambihari/- U T
