Petitioner, who is in custody, seeks bail in connection with Gamhariya P.S. Case No. 39 of 2018 registered for the offences punishable under Sections 341, 323, 325, 307, 302, 504, 506 and 34 of the Indian Penal Code. Allegation against petitioner is assaulting informant by iron rod as well as assaulting Mahendra Yadav (deceased) by iron rod as a result of which both had sustained injuries on their hand. Mahendra Yadav (deceased) died of head injury. There is no allegation against petitioner of causing head injury on him It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to dirty village politics.

Patna High Court Cr.Misc. No.57689 of 2018(3) dt.29-10-2018 2/2 Allegation against petitioner is causing hand injury to the informant as well as deceased. There is a case and counter case between the parties. He has no criminal antecedent. He is in custody since 20.06.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., IVth, Madhepura in connection with Gamhariya P.S. Case No. 39 of 2018.
