The petitioner is seeking a direction to the respondents to make necessary corrections in the official records and pay compensation against the acquisition of his land under the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act of 2013'). The petitioner is claiming his right, title and interest over the land, in question, on the ground that the same was settled by ex-landlord in favour of his father. He appears to have raised an objection before the Land Acquisition Officer, Saran at Chapra on 15.11.2018, a copy of which has been brought on record by way of Annexure-P7 to the writ application.
Patna High Court CWJC No.12924 of 2019(2) dt.16-07-2019 2/2 The question raised by the petitioner regarding his title over the land, in question, is such question of fact, which cannot be decided by this Court in a proceeding under Article 226 of the Constitution of India, unless all facts are admitted. Be that as it may, if the petitioner has raised the objection, the same shall be considered and disposed of in accordance with law.
