The petitioner apprehends his arrest in a case under Section 379 of the Indian Penal Code.

The petitioner is suspected in the case of theft of motor cycle but nothing has been recovered from the possession of the petitioner. Nobody has seen the petitioner committing the theft but it appears that the petitioner has got criminal antecedent and he is accused in a case registered under section 413 and 414 of the IPC.

Considering the fact that the petitioner has got criminal antecedent, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. BKS/- (Prabhat Kumar Jha, J) U T
