The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 380, 411 of the Indian Penal Code.

It is alleged that this petitioner along with his son co-accused Sonu Kumar have fled away with the money of the informant worth rupees thirty five lakhs. The police subsequently recovered rupees thirty four lakhs from the possession of the co-accused persons. It is submitted by learned counsel for the

Patna High Court CR. MISC. No.53556 of 2021(3) dt.12-05-2022 2/2 petitioner that petitioner was not apprehended from the spot. Nothing incriminating has been recovered from the possession of the petitioner. The petitioner has been implicated in this case only because he happens to be the father of co-accused Sonu Kumar.

From perusal of the case diary as well as impugned order, it appears that there is direct allegation against the petitioner in the commission of theft of money of the informant.

Considering the facts aforesaid, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
