Learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. In this case, the petitioner apprehends his arrest in connection with Warisaliganj P.S. Case No. 83 of 2019 registered for the offences punishable under sections 332, 333, 353/34 of the Indian Penal Code.
Allegation against the petitioner is that he was uploading sand after excavating it by JCB machine and the police party came there. They hurled brick bats on the police party and raised slogan.
Patna High Court CR. MISC. No.40278 of 2020(2) dt.09-12-2021 2/2 Learned counsel for the petitioner has submitted that two accused persons on similar ground have been granted anticipatory bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 38761 of 2020 vide order dated 25.10.2021. Considering the nature of allegation as well as also considering that other co-accused have been granted bail by the Co-ordinate Bench of this Court, the petitioner above named, in the event of his arrest or surrender, within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nawada/Successor Court in connection with Warisaliganj P.S. Case No. 83 of 2019, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
