JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-12-2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Banshi P.S. Case No.13 of 2016 for the offences registered under sections 420, 409 and 34 of the Indian Penal Code.

Petitioner was working as Block Education Officer and superannuated from service on 31.1.2014, which has specifically been pleaded at paragraph-12 of the petition. The accusation against the petitioner is that he did not provide the merit list of appointee teachers. Submission on behalf of the petitioner is that the merit list was in the office of concerned department and, as a matter of fact, the aforesaid demand was made after retirement of the petitioner

Patna High Court Cr.Misc. No.44227 of 2016 (3) dt.01-12-2016 2/2 and petitioner was not in a position to produce the aforesaid document. Moreover, one co-accused Sri Upendra Prasad, having more or less similar allegation, has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M., Arwal in Banshi P.S. Case no. 13 of 2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
