JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks bail in connection with NDPS Case No. 11/2017, arising out of Chouradano P.S. Case No.13 of 2017, G.R. No. 56 of 2017, registered for the offences punishable under Sections 18, 20 and 22 of the NDPS Act. Earlier prayer for bail of the petitioner were rejected by this Court, vide order dated 07.07.2017 passed in Criminal Misc. No.21668 of 2017 and vide order dated 25.04.2018 passed in Criminal Misc. No. 15160 of 2018.

Submission of the learned counsel for the petitioner is that earlier there was a direction to conclude the trial within six months from the date of receipt of the order. Heard learned APP also and perused the report submitted by the 1st Additional Sessions Judge, East Champaran,

Patna High Court CR. MISC. No.53539 of 2019(4) dt.25-09-2019 2/2 Motihari, from which, it appears that case is fixed for argument and as soon as the arguments of the defence will be concluded, the judgment will be passed within one month. Having heard both sides, in view view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial.

With the above observations, this application is dismissed.
