The petitioner seeks bail in connection with Aurangabad (T) P.S. Case No. 113 of 2017 dated 07.04.2017 instituted for the offences under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.
The petitioner is elder brother of the husband of the informant, who is alleged to have managed a fake sale deed with respect to a plot of land with some construction over the said land, in his favour when the husband of the informant had actually purchased the same.
During the course of investigation of this case, a settlement was arrived at, keeping in mind the relationship between the parties.
Patna High Court Cr.Misc. No.48174 of 2017 (4) dt.30-11-2017 2/2 Learned counsel appearing for the petitioner has also submitted that a Title Suit between the parties has also been filed bearing Title Suit No. 41 of 2017.
Taking into account the fact that the case is basically in the nature of a civil dispute and there has been a settlement between the parties, this Court is inclined to grant bail to the petitioner. While saying so, the Court has also taken note of the fact that petitioner is in custody since 20.06.2017 and does not have any criminal antecedent.
The petitioner, above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) P.S.
