JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 354, 504, 506, 456,l 427, 436, 120B/34 of the Indian Penal Code. The prosecution case is that the co-accused Anish Kumar, petitioners and others used to tease the daughter of the informant while she used to go college and when the informant made protest to the father of the petitioner no. 2, he was abused and threatened. it is further alleged that accused persons one day prior to the lodging of the F.I.R went to the roof and damaged the water tank, and due to firing made by them, curtain of the house caught fire, as a result the motorcycle of the informant also got burnt.
It is submitted by learned counsel for the petitioners that neither accusation of teasing nor accusation of firing is against any accused and the accusations are omnibus
Patna High Court Cr.Misc. No.42002 of 2015 (2) dt.13-10-2015 2/2 and general. Moreover for the initial occurrence of 7/3/2015 the first information report was registered on 29/3/2015. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 58 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
