Versus

1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Pawan Kumar Singh For the Opposite Party/s : Mr. Sri Ram Sevak Choudhary ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-11-2017 Heard the parties.

This application is for grant of regular bail in connection with Chainpur P.S.Case No.45 of 2017 for the offences punishable under Sections 341, 307, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of firing on the injured causing injury to him.

Submission of the learned counsel for the petitioner is that all the injuries are simple in nature, further there is no allegation of repetition of firing and he is in custody for about 2 1⁄2 months.

Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the

Patna High Court Cr.Misc. No.49221 of 2017 (3) dt.09-11-2017 2/2 injury report shows that the injuries were found on the left leg and left thigh. The petitioner has no criminal antecedent. Having heard both sides and in view of facts and circumstances, at this stage, I am not inclined to grant bail to the petitioner, however, once the charge-sheet is submitted in this case, the learned trial court shall verify the injuries and if the injuries are simple in nature, he will release the petitioner in connection with Chainpur P.S.Case no.45 of 2017 to his own satisfaction.

With the aforesaid observation, this application is disposed of.
