JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 436/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that someone put fire in the house of the informant when suspicion was raised against the petitioner being the neighbour of the informant. It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and subsequently, the informant has retracted from his initial version and filed a petition to that effect before the learned court below. Moreover, for the occurrence of 22.07.2015, the FIR was registered on 30.07.2015. A statement has been made in para 3 of

Patna High Court Cr.Misc. No.51368 of 2015 (2) dt.10-11-2015 2/2 the petition that the petitioner has no criminal antecedent. Considering the delayed lodging of the case and suspicious nature of accusation, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 197 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
