Learned counsel for the informant appeared through vakalatnama but he is not present in the Court.
2. The petitioner seeks regular bail in connection with Falka P.S. Case No. 282 of 2023, lodged under Sections 376, 313, 504, 506/34 of the I.P.C., Section 4 POCSO Act, and Sections 3(i)(r)(s) of the SC/ST Act.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 14.03.2024 passed in Cr. Misc. No. 17287 of 2024 in which liberty was granted to him to renew his prayer for bail after framing of charge.
4. Learned counsel for the petitioner further submits that the charge has already been framed in this case and
Patna High Court CR. MISC. No.47534 of 2024(3) dt.31-08-2024 2/2 prosecution evidence has been started.
5. Learned counsel for the State opposes the prayer for bail and submits that on earlier occasion report has been called for and from the said report, it transpires that the charge has already been framed and the prosecution evidence is going on and no purpose shall be solved keeping the petitioner in custody.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-VI-Cum Special Judge (POCSO), Katihar in connection with Falka P.S. Case No. 282 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C. (Dr. Anshuman, J) sunny/amandeep U T
