This is an application for bail in connection with Bariyarpur P.S.Case No. 19 of 2017, G.R.No. 360 of 2017, registered for the offences punishable under Sections 376 of the Indian Penal Code and 4 & 6 of POCSO Act.
Allegation against the petitioner is of committing rape upon the prosecutrix, who happens to be his own daughter. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and there is no other circumstance except statement of prosecutrix under Section 164 Cr.P.C. and as a matter of fact no such occurrence took place and he is in custody since 17.2.2017.
Heard learned APP also, who has opposed the prayer for bail.
Patna High Court Cr.Misc. No.50229 of 2017 (3) dt.13-11-2017 2/2 Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and try to conclude it as early as possible. At the same time, Superintendent of Police, Munger is directed to ensure presence of the witnesses in court.
