Petitioner seeks regular bail in connection with Dhoraiya PS Case No. 111/2017 registered for the offence punishable under Sections 392 of the IPC.
As per First Information Report, four miscreants riding on two motorcycles intercepted the informant and snatched a sum of Rs.89,287/-, POS Machine, Bag etc. Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name has transpired on the basis of confessional statement made by one co-accused, namely, Vicky @ Vikash Mandal who has been granted bail by a co-ordinate Bench of this Court vide Annexure-2. Patna High Court CR. MISC. No.53387 of 2021(3) dt.12-05-2022 2/2 submits that no incriminating material and or looted article has been recovered from the possession of the petitioner and he is in custody since 13.06.2021.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that a co-accused has been granted bail by a Bench of this Court, I am inclined to grant regular bail to the petitioner after completion of one year of custody.
Accordingly, let the petitioner, GHANSHYAM PASWAN be released on bail, after completion of one year of his custody, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya PS Case No. 111/2017.
