The petitioners apprehend their arrest in connection with Sheikhpura SC/ST, PS Case no. 18/15 for offences alleged under Sections 147, 148, 341, 323, 354, 379, 504 of the Indian Penal Code and Section 3 (R) (S) (W) (11) SC/ST Act and Section 8 of POCSO Act.
The prosecution case, as lodged by the informantShyama Devi, is that her daughter namely Sudha Kumari aged about 14 years went for natural call on 19-07-2015 at 07:00 PM. When she was returning one Rampreet Chauhan who was watching her in the lane caught her hand and told that he was watching her since long upon which her daughter fled away by raising hullah. On hullah she reached there and saw that Rampreet was going to his house upon which she reached at the house of Rampreet and complained to his family members upon which Sita Ram Chauhan, Bajrangi Chauhan, Rampreet Chauhan wife of Bajrangi Chauhan and sister Rambatiya Devi all residents of village Lodipur Beldariya have abused her by naming her caste and assaulted her by fist and slaps and Bajrangi Chauhan has snatched golden ear ring worth of Rs. 15,000/- and at the time of
Patna High Court Cr.Misc. No.52232 of 2015 (2) dt.11-12-2015 2/2 occurrence Germany Paswan, Yogendra Paswan and 15-20 persons has seen the occurrence.
It has been submitted by the counsel for the petitioners that the allegations against the petitioners are not specific and general in nature. The only allegation against the petitioners is that they abused and that also cannot be attributed only to the petitioners. It has further been submitted that there is some personal enmity and the FIR has been lodged after delay of 24 hours, which is an after thought.
Be that as it may, let the petitioners, named above, in the event of their arrest/surrender before the Court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with sureties of the like amount to the satisfaction of the learned 1st A.D.J. Sheikhpura in Sheikhpura SC/ST P.S. Case no. 18/2015, subject to the condition as laid down under Section 432 of the Cr.P.C. (Nilu Agrawal, J) singh/- U T
