JUSTICE SUDHIR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Saur Bazaar (Patarghat O.P.) P.S. Case No. 35 of 2010 for the offences instituted under Sections 467, 468, 471 and 420 of the Indian Penal Code.
As per the prosecution case, it is a case of annexing forged certificate with application for being considered for appointment of Physical Trained Teacher.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner's certificate was a genuine certificate which was issued by the institution but the institution was subsequently derecognized by the State
Patna High Court Cr.Misc. No.55075 of 2015 (3) dt.20-01-2016 Government and for the said reasons, the petitioner had never tendered his joining. Other co-accused persons have been granted anticipatory bail by this Court vide Cr.Misc.No.19884 of 2012. On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Saur Bazar (Patarghat O.P.) P.S. Case No.35 of 2010 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
