The petitioner is in custody since 04.12.2021. in connection with Paliganj P.S. Case No. 459 of 2021 registered for the offence punishable under Sections 304(B)/201/34 of the Indian Penal Code.
The City Superintendent of Police, West, Patna (Sri Rajesh Kumar), Assistant Superintendent of Police, Paliganj (Sri Avdhesh Dixit) and the S.H.O., Paliganj (Sri Vijay Kumar Gupta) have appeared in this Court and the Court has interacted with them.
They have apprised this Court that the deceased died as she had committed suicide and petitioner's husband at the time of death was in Chennai though there was a dispute between the husband and wife with regard to the wife's wishes
Patna High Court CR. MISC. No.42893 of 2022(4) dt.15-02-2023 2/2 of staying in Chennai.
Considering the fact that the charge-sheet has been submitted under Section 306 of the of the Indian Penal Code and the petitioner is in custody since 04.12.2021, this application for regular bail is allowed.
Let the petitioner above named be released on bail after framing of charge if the charge in not framed yet or on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M, Danapur in connection with Paliganj P.S. Case No. 459 of 2021.
The personal appearance of the officers is dispensed with.
