JUSTICE S. KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Majorganj P.S. Case No. 159 of 2016 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is of committing murder of one Dharamveer. The FIR is registered against three unknown persons. Name of the petitioner transpired on the basis of secret information received by I.O. through spy. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to previous enmity

Patna High Court Cr.Misc. No.45040 of 2017 (2) dt.21-09-2017 between the parties. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 19.08.2017. It is further submitted that several co-accused having similar allegation have already been granted the privilege of bail by different Benches of this Court.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-I, Sitamarhi, in connection with Majorganj P.S. Case No. 159 of 2016.
