The petitioner is in custody since 18.09.2017 in connection with Rajiv Nagar P.S. Case No. 240 of 2017 for the offence registered under Sections 380 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the first information report but on the basis of the confessional statement made before the police, the petitioner has been roped into the present case. It is further submitted that the petitioner has not been put on T.I. Parade and there is no recovery from the conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the

Patna High Court Cr.Misc. No.58760 of 2017 (2) dt.13-12-2017 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in connection with Rajiv Nagar P.S. Case No. 240 of 2017 corresponding to G.R. No. 5802 of 2017.
