2. The petitioner seeks bail in connection with Anagarghat P.S. Case No. 12/2023 registered for the offence punishable under Sections 394/302 of the Indian Penal Code.

3. As per the prosecution, unknown criminals murdered the wife of the informant, looted cash of Rs. 1, 50,000/- and ornaments worth Rs. 1,75,000/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that he has not been put on T.I. Parade nor the articles looted from the house of the informant which have been seized from the petitioner have been put on T.I. Parade. The petitioner is in jail since 07.02.2023.

5. I have considered the submission of the parties including the learned counsel for the informant.

6. Part of the looted amount i.e. Rs. 45,000/- and one earring has been seized from the house of the petitioner who has confessed the crime also.

7. Similarly situated criminals Gulshan Kumar and Shivam Kumar have been granted bail by this Court vide order dated 31.01.2024 and 17.10.2023 passed in Cr. Misc. No. 3567 of 2024 and Cr. Misc. No. 46472 of 2023 respectively.

8. Considering the facts and circumstances of the case and also the recovery, I am not inclined to grant bail to this petitioner. It is accordingly, dismissed.
