====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 09-07-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. In the present case, the petitioner seeks bail in connection with Manjhaul P.S. Case No. 64 of 2024, registered for the offences under Sections 115(1), 308(1), 308(4), 351(3), 3(5) of the B.N.S. and Section 27 of the Arms Act.

3. As per the prosecution case, petitioner and coaccused persons came to the doors of the informant and brandishing pistols demanded extortion money of Rs.3,50,000/- from the informant. They threatened the informant that if extortion was not paid he and one of his family members would be killed.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

Patna High Court CR. MISC. No.41632 of 2025(2) dt.09-07-2025 2/3 falsely implicated in this case. No occurrence as alleged has ever taken place. From bare perusal of the FIR, it is apparent that no specific overt act has been raised against the petitioner and story of demanding extortion money appears to be false and concocted. The distance of police station is only 1 km from the place of occurrence which took place on 20.08.2024 but the FIR has been lodged only on 22.08.2024. Charge sheet has been submitted and petitioner is in custody since 05.02.2025. Though the petitioner is having antecedent of nine cases, he is on bail in all such cases.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the vague and non-specific allegation against the petitioner and also considering submission of charge sheet and period of custody of the petitioner, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Manjhaul (Begusarai) /concerned court, in connection with Manjhaul P.S. Case No. 64 of 2024, subject to the condition laid down under Section 480(3)

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
