The petitioner is apprehending his arrest in a case registered under Sections 302/34 of the Indian Penal Code. Allegation is that the informant's son, namely, Soharai Singh was killed by accused Sujit Singh and 3-4 unknown persons due to illicit relation between Sujit Singh and Rina Devi, the wife of the deceased.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no eye witness to the alleged occurrence. Except for the confessional statement of the co-accused there is no other substantive evidence

Patna High Court Cr.Misc. No.51118 of 2016 (3) dt.13-01-2017 2/2 to suggest his implication in the present case. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Barun P.S. case No.64 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
