JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-01-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Chapra Town P.S. Case No. 282 of 2015 (arising out of Complaint Case No. 2474 of 2015) registered under Sections 120B, 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is that petitioners being the nephew of the complainant/informant got executed the forged gift deed on 18.03.2014 to the land of complainant/informant by putting the fake person in her place.
Learned counsel for the petitioners submits that, in
Patna High Court Cr.Misc. No.1920 of 2017 (2) dt.30-01-2017 fact, petitioners are the nephew of the complainant/informant and she was being taken care by these petitioners, due to that reason, the informant executed the gift deed but on pressure of daughter and son-in-law, complainant/informant filed the present case with false allegation. Moreover, Title Suit No. 456 of 2015 is also filed by the complainant/informant against the petitioners and others, which is pending in the court of Sub-Judge-I, Saran at Chapra. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Saran at Chapra, in connection with Chapra Town P.S. Case No. 282 of 2015, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
