The petitioners seek bail in anticipation of their arrest in connection with Sri Nagar Pujaha P.S. Case No. 51 of 2020 dated 23.05.2020 instituted for the offences under Sections 341, 323, 354(B), 452, 324, 379 and 34 of the Indian Penal Code.

It has been alleged in the FIR that the petitioners and another entered the house of the informant and subjected her to physical misdemeanor.

Patna High Court CR. MISC. No.39586 of 2020(3) dt.08-12-2021 2/2 It has been alleged in the FIR that the husband of the informant had married twice, she being the second wife of her husband. The petitioners happen to be the relatives of the first wife who had entered the house of the informant only to teach her a lesson.

Regard being had to the nature of accusation against the petitioners and the background facts, I am not inclined to grant anticipatory bail to them. Accordingly, the prayer for anticipatory bail is rejected.

However, if the petitioners surrender before the court below and seek bail, all the above noted facts shall be taken into account and an order shall be passed in accordance with law without being prejudiced by the fact that the present petition on their behalf has not been entertained.
