JUSTICE ARUN KUMAR ORAL ORDER 21-09-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Madhuban P.S.Case No. 184 of 2017 registered under Sections 341, 323, 324, 325, 307, 379 and 504/34 of the Indian penal Code.
Allegation in brief is that accused persons assaulted the informant, his father, uncle and wife causing injuries to them. Submission is that both sides are agnates and earlier case was lodged by the petitioner's side on 11.07.2017 and in the present case, the police has submitted final form exempting the petitioner under Sections 307 and 379 of the Indian Penal Code as the police did not find any offence made out under the aforesaid sections and the petitioner is in custody since 26.07.2017 and he has got no criminal antecedent.
Patna High Court Cr.Misc. No.46781 of 2017 (2) dt.21-09-2017 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Birendra Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, SAdar Motihari, East Champaran in connection with Madhuban P.S. Case No. 184 of 2017.
