This application is for grant of regular bail in connection with Bettiah Town P.S.case No.675 of 2017 dated 25.9.2017 for the offences under Sections 20, 22,, 23, 24, 25, 27A, 29 of the Narcotic Drugs and Psychotropic Substances Act. Allegation against the petitioner is about recovery of 440 grams of Charas and Puria of smacks from the house of the petitioner and wife of the petitioner was arrested and he succeeded in fleeing away.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and the recovery is less than the commercial quantities. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.58554 of 2018 (3) dt.02-11-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail.
With the aforesaid observation, this application is dismissed.
