In this case, the petitioner is seeking anticipatory bail in connection with Dumraon P.S. Case No. 167 of 2019, registered for the offence under Sections 406 and 420 of the Indian Penal Code.
Under the scheme of 'Sabke Liye Aawas', the Government has given Rs.50,000/- for construction of the house and while taking the money the petitioner has given an undertaking that the land is not a disputed land, but later on, it transpired that the land is disputed, thereby misappropriated the Government fund.
Learned counsel for the petitioner submits that the petitioner is constructing the house and a tittle suit is pending

Looking to the entire facts and circumstances of the case, let the above-named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Dumraon P.S. Case no. 167 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
