The petitioner seeks bail in a case instituted for the offences under Sections 379, 411, 413 and 34 of the Indian Penal Code.
Prosecution allegation, in short, is that the accused persons tried to commit loot of the motorcycle of the informant but was apprehended.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.5.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to previous
Patna High Court CR. MISC. No.44023 of 2019(2) dt.17-07-2019 2/2 enmity. The petitioner had given money to the informant and he had gone to collect the same. The allegations made in the F.I.R. is denied. It is further submitted that the petitioner may be released after completion of five months in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, on completion of five months in custody, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 218 of 2019, G.R. No. 1249/2019. (Sudhir Singh, J) Pankaj/- U T
