The petitioner seeks bail in Belhar P.S. Case No. 190 of 2021, registered for the offence punishable under Sections 498(A), 494 and other allied sections of the Indian Penal Code. As per the FIR, informant was married with this petitioner eight years ago. Petitioner performed second marriage with Archana Devi. Thereafter, petitioner and his second wife used to torture the informant physically and mentally. On 11.06.2021 at 9.00 pm petitioner and his second wife abused, assaulted and ousted her from matrimonial home. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. No such
Patna High Court CR. MISC. No.53099 of 2021(2) dt.01-12-2021 2/2 occurrence has taken place. Petitioner never demanded any dowry. As a matter of fact, petitioner has taken a loan of Rs. 1,42,000/- from the relative of informant and on the issue of return of money this false case has been lodged against petitioner. Petitioner claims clean antecedent and he is in custody since 29.06.2021.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 190 of 2021.
