The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code. The accusation is of realizing fifty thousand rupees for providing employment in BCCL to the son of the informant, but neither the employment was provided nor the money was returned when accusation was made against others also.

It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment

Patna High Court Cr.Misc. No.42799 of 2015 (2) dt.13-10-2015 2/2 whereas others have been granted anticipatory bail. Since the case was instituted in 2009, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that others have been granted anticipatory bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Khizarsarai P.S. Case No. 80 of 2009 pending in the court of learned Judicial Magistrate, Ist Class, Gaya.

With the aforesaid observation, this application is disposed of.
