====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 17-01-2017 Heard Sri Anil Kumar, learned counsel for the petitioner and learned counsel, who has appeared on behalf of Opp.Party/ husband of the petitioner.

The petitioner has filed the present petition under Section 24 of the Code of Civil Procedure with a prayer to transfer the Matrimonial Suit Divorce Case No.120/13 from the court of learned Principal Judge, Family Court, Munger to the court of Principal Judge, Family Court, Gaya. By order dated 16.06.2014, while directing for issuance of notice to Opp.Party, this Court had directed for staying further proceeding in Matrimonial Case i.e. Divorce Case no.120 of 2013.

Learned counsel appearing on behalf of

Patna High Court MJC No.3694 of 2013 (3) dt.17-01-2017 2/2 husband/Opp.Party, on instruction, submits that the husband is ready to keep the petitioner as wife with full respect and dignity. He submits that even the husband is ready to withdraw divorce case, for which transfer has been sought for in the present case. Learned counsel for the petitioner is in agreement with the submission made by learned counsel for Opp.Party. He also submits that if her husband/Opp.Party is ready to keep her wife with full respect, there is no reason to contest this case. In view of submission made by learned counsel for the parties, there is no need to keep the matter pending. The petition stands disposed of with indication that the order of stay dated 16.06.2014 shall continue till the date of filing of petition by Opp.Party in the court of learned Principal Judge, Family Court, Munger for withdrawing Divorce Case no.120/2013. The petition stands disposed of.
