JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 03-11-2015 Heard counsel for the petitioners and APP for the State. The three petitioners herein seek anticipatory bail in Uchakagaon P.S. Case No. 137 of 2015 registered under sections 307, 379 and 354-A/34 IPC. The informant has alleged that while she was on way to her house the petitioners intercepted her and forcibly brought to the nearby maize field and tried to outrage her modesty. On protest, the informant was assaulted with iron rod and Lathi.
The contention of the petitioner is that out of family feud the case has been lodged. Prior to this, the brother of the petitioners had lodged a case against the informant and her family members.
Patna High Court Cr.Misc. No.48955 of 2015 (2) dt.03-11-2015 2/2 Regard being had to the allegations and the injury sustained by the informant, as reflected from annexure-4, I am not inclined to extend the privilege of anticipatory bail to the petitioners. While rejecting the prayer, it is observed that if the petitioners surrender and seek regular bail, the trial court shall consider and dispose of the same in accordance with law unprejudiced by this order.
