JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner.

The petitioner apprehends his arrest in a case under sections 376/34 of the Penal Code.

It is alleged that the petitioner developed relationship with the victim girl and indulged in sexual act, on account of which she became pregnant. The petitioner submits that prior to lodging the first information report, he has filed a Complaint Case No.1580 of 2015. Besides this, the sexual indulgence was consensual and as such no case under section 376/34 of the Penal Code is made out.

On the other hand the prosecution case is that the girl became pregnant by the petitioner, who evaded marrying her. In view of the allegations, I am not inclined to grant anticipatory bail to the petitioner. His prayer for anticipatory bail is, accordingly, rejected. (Samarendra Pratap Singh, J) KHAN/- U T
