JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.1.2018 in Cr.Misc.No. 61291 of 2017 and there is recovery of 22 and odd kg. of ganja from the possession of petitioner and one more accused. Submission of learned counsel for the petitioner is that there was recovery of 7.650 kg. of ganja from the petitioner and petitioner is in custody for one and a half years and now three witnesses have been examined out of six. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.60213 of 2018(4) dt.02-01-2019 2/2 satisfaction of Additional District Judge-III, Katihar, in connection with Kishanganj Rail P.S.Case No. 32 of 2017, corresponding to G.R.No. 128 of 2017, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
