This application for anticipatory bail arises out of Katihar Town P.S. Case No. 425 of 2016, disclosing offences under Sections 384, 388/34 of the Indian Penal Code. On call, I find that there is no representation on behalf of the State despite name of Sri Rana Randhir Singh is appearing in the daily cause list. In such circumstance, this Court has no other option but to allow the prayer for anticipatory bail of the petitioner.

Accordingly, this application is allowed. Let the petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on

furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar, in Katihar Town P. S. Case No. 425 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.

Considering the fact that despite the name of learned Additional Public Prosecutor, (Rana Randhir Singh) is appearing in the daily cause list and there is no representation on behalf of the State, I direct the Secretary, Department of Law to take steps for removal of his name from the panel of the APP. Let a copy of this order be communicated to the Chief Secretary and the Director General of Police, Bihar, Patna, forthwith.
