The petitioner apprehends his arrest in Makhdumpur (Tehta) P.S. Case No. 212/2016, registered for the offences punishable under Sections 409 and 420 the Indian Penal Code. The informant Block Education Officer, Makhdumpur alleged that the petitioner was Panchayat Sachiv of Panchayat Soren and Sugaon, but he did not submit seven and one folders and registers with regard to appointment of Panchayat teachers.

Learned counsel for the petitioner submits that the petitioner submitted before the authority concerned that he joined in the said panchayat in the year 2013 and he never received

Patna High Court Cr.Misc. No.55280 of 2016 (3) dt.17-01-2017 2/2 charge of those folders and registers. At best this amounts to dereliction of duty and nothing has been misappropriated. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta) P.S. Case No. 212/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
