Mr. Umeshanand Pandit ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-01-2022 Heard learned counsel for the petitioner and the State. The matter has been taken up through video conferencing.

Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. Later on charge sheet has been submitted u/s 395/412 of the IPC.

As per the prosecution case, some unknown miscreants looted the motor cycle of the informant. The name of petitioner has surfaced in this case during the course of investigation because looted motor cycle of the informant has been recovered from the house of this petitioner. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.53138 of 2021(3) dt.21-01-2022 2/2 that petitioner is not named in the FIR. It is submitted that petitioner is a motor cycle mechanic and earns his livelihood by running his repairing work and alleged looted motor cycle was parked in front of his shop and the same has not been recovered from his possession. Till date petitioner has not been put on Test Identification Parade though informant claims to identify the culprits if they were shown to him. Petitioner is in custody since 12.10.2020 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Supaul in connection with Birpur PS case No.118/2020.
