The petitioners seek bail in a case instituted under Section 30(A) of Bihar Prohibition and Excise Act, 2016. It is alleged that raw material for Mahua wine is said to have been recovered.

It has been submitted on behalf of the petitioners that the petitioner no. 1 and 2 are in custody since 16.08.2017 and petitioner no.3 is in custody since 18.07.2017. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. It is alleged that raw material for Mahua wine is said to have been recovered. No seizure list has been prepared. The petitioners have falsely

Patna High Court Cr.Misc. No.50249 of 2017 (2) dt.17-10-2017 2/2 been implicated in the present case. There is no compliance of section 100 of the Cr.P.C.

On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Patna, in connection with Shastri Nagar P.S.
