KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks regular bail in connection with Forbesganj Police Station Case No. 461 of 2016, registered for the offence punishable under Section 386 of the Indian Penal Code.

The allegation against the petitioner is by the informant is of demand of Rs. 1. 5 lakhs as ransom on his mobile phone.

Learned counsel for the petitioner submits that the recovered mobile does not belong to the petitioner and the voice related to the petitioner has been sent to the F.S.L., Patna and report is still awaiting. It has further been submitted that informant

Patna High Court Cr.Misc. No.49082 of 2017 (2) dt.18-10-2017 is neighbour of petitioner and he has falsely been implicated in this case and younger brother of petitioner has also been made accused in this case and charge sheet against both the accused persons has submitted by the police. It has further been submitted that petitioner is in custody since 06.09.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Araria, in connection with Forbesganj P.S. Case No. 461 of 2016.
