1. Heard learned counsel for the petitioner and learned A.P.P. for the State. No one appears for the opposite party no.2.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Complaint Case no. 1941 of 2023 registered under section 498A of the Indian Penal Code.
3. As per the prosecution case, the complainant states that she fell in love with the petitioner in the year 2019 and entered into a physical relationship on the petitioner promising to marry her. Though the petitioner refused to marry the
Patna High Court CR. MISC. No.48699 of 2024(2) dt.08-08-2024 2/3 complainant, however subsequently, on threat of going to the police station, he entered into marriage. The complainant states that soon after marriage, the accused persons started to make demand of Rs. 2 lacs by way of dowry. Further allegation of assault etc and the complainant undergoing abortion on two occasions have been levelled.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Though they were acquainted, however no marriage at any stage took place between the parties. The complaint has been lodged with false and concocted allegations. Cognizance has been taken vide order dated 24.4.2023 under section 498A of the Indian Penal Code. The petitioner has no criminal antecedent and undertakes to cooperate in the case.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the petition of complaint, the submissions made by learned counsel for the petitioner and the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned

No.48699 of 2024(2) dt.08-08-2024 3/3 Court below within a period of four weeks, be released on anticipatory bail in connection with Complaint Case no. 1941 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna.
