ANJANA MISHRA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehend their arrest in connection with Chiraiya (Sikarganj) P.S. Case No. 133 of 2016 for the offences registered under Sections 272 and 273 of the Indian Penal Code and Section 47 (a), 51 of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioners submits that the alleged recovery has not been made from the conscious possession of the petitioners and the seizure list has not been signed by him.

Patna High Court Cr.Misc. No.47074 of 2016 (3) dt.18-11-2016 Considering the nature of allegation and that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Sikrahana, East Champaran at Motihari in connection with Chiraiya (Sikarganj) P.S. Case No. 133 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
