Case No.82 of 1997, Trial No.74 of 2010) is listed for hearing.

2. Despite repeated calls, none appears on behalf of the appellant, whereas Ms. Shashi Bala Verma, learned, Additional Public Prosecutor for the State is present.

3. Perusal of record shows that a living status report of accused appellant was called for by the Assistant Registrar, Criminal Appeal Section of this Court. In response thereto, Superintendent of Police, Jamui, submitted a report dated 03.05.2026 based on the information furnished by S.H.O.,

Patna High Court CR. APP (DB) No.568 of 2010(3) dt.24-07-2026 2/2 Malayapur Police Station, Jamui, apprising this Court that the sole appellant namely, Baij Nath Yadav has died during pendency of this Criminal Appeal. The Death Certificate dated 30.04.2026 issued by the Mukhiya, Gram Panchayat Raj, Bariyarpur, Barhat, Jamui is also enclosed along with the said report.

4. In view of the above, the instant Criminal Appeal filed by appellant Baij Nath Yadav stands abated.
